Distance sales agreement

The terms of service govern what you may do with the software. This document governs the purchase: what is sold, for how much, how it reaches you, and how it is cancelled. It is concluded at a distance, by electronic means, and you accept it before you pay.

1. Parties

The supplier is Arif Hacı Bayram Kurnaz, a sole trader registered in Türkiye at Dörtyol Küme Evleri No: 369, İç Kapı No: 3, Işıklar, Merkez, Çanakkale, Türkiye, Çanakkale Tax Office · Tax no 13004922360, trading as Attestkeep. The buyer is the person or organisation named on the account that places the order, at the billing address given at checkout. Where the buyer is an organisation, the individual placing the order confirms they are authorised to bind it.

The merchant of record is Paddle.com Market Ltd, which sells the product to you on our behalf, issues the invoice, collects and remits the applicable tax and processes the payment. Paddle's buyer terms apply to the payment transaction alongside this agreement, and where they give you a right that this agreement does not, that right stands.

2. Subject

This agreement covers the sale of a time-limited licence to Attestkeep software, delivered electronically as a licence key, together with the entitlements attached to the edition purchased. It does not transfer ownership of the software, which stays with us; what you may do with it is set out in the terms of service.

3. Product and price

The editions, their cluster quotas and their prices are on the pricing page, which forms part of this agreement for the order you place. Prices are shown exclusive of VAT; the tax applicable to your billing address is calculated and added at checkout, and the total payable is displayed before you confirm.

Licences are sold for a term of one year unless the order says otherwise. Community Edition is free of charge, needs no payment method, and no sale takes place for it — this agreement then applies only to the extent that it describes delivery and termination.

4. Payment

Payment is taken by Paddle at checkout, by the method you choose there. We do not receive or store card details at any point. Paid editions may start with a trial period, in which case the payment method is registered at the start of the trial and the first charge falls on the first day after it ends; the length of the current trial is stated on the pricing page and at checkout.

If a charge fails, the licence stays active for a grace period during which we will try again and tell you by e-mail. If it still fails, the licence falls back to Community Edition rather than stopping: enforcement in your cluster continues under the free limits.

5. Delivery

Delivery is electronic and immediate. The licence key is issued to the account and sent to the account's e-mail address as soon as the payment is confirmed — in normal operation within minutes. There is no physical shipment, no delivery charge and no carrier.

If the key does not arrive, it is also visible in the account, and support@attestkeep.com will reissue it. A failure of delivery is our responsibility to fix; you are not asked to pay twice for a key that did not reach you.

6. Right of withdrawal

A licence key is digital content supplied on an intangible medium and delivered immediately. Under Turkish consumer legislation — and its equivalents elsewhere — the statutory right of withdrawal does not apply to such content once supply has begun with your prior consent. By placing the order you ask for delivery to start immediately and acknowledge that you thereby lose the right of withdrawal.

This is why the free edition and the trial exist. Community Edition is a full edition rather than a countdown, and the trial runs the complete feature set in your own cluster. You can evaluate everything before any money moves, which is a better protection than a cooling-off period you would spend reading a licence file.

Where a purchase fails because of a defect on our side, or you were charged for something you did not order, we refund it. Write to support@attestkeep.com with the invoice number. Refunds are made through Paddle to the payment method that was charged. The billing page says the same thing in fewer words.

7. Cancellation and renewal

A subscription renews automatically at the end of its term at the same price unless it is cancelled. Cancel from the licence page in the account; no e-mail, call or reason is required. We give notice by e-mail before a renewal charge.

Cancelling stops the next renewal and does not shorten the term already paid for. The licence runs to the end of that term with every feature, and then falls back to Community Edition. Nothing you have already recorded — evidence, attestations, audit history — is removed by the fallback.

8. Term and termination

This agreement takes effect when your order is confirmed and stays in force for as long as a licence issued under it is valid. Either party may terminate for material breach that is not remedied within thirty days of written notice. We may suspend a licence immediately in the cases listed in the terms of service, which also govern what happens to the software after termination.

9. Complaints and disputes

Complaints go to support@attestkeep.com first, and anything unresolved to legal@attestkeep.com. We answer in writing. Complaints about the invoice, the charge or the tax on it are Paddle's to answer as merchant of record, and we will pass them on if they reach us first.

If you are a consumer resident in Türkiye, you may take a dispute to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court in your place of residence, up to the monetary limits published each year by the Ministry of Trade. Nothing in this agreement removes that right. Otherwise the governing law and forum are those stated in the terms of service.

10. Notices

Notice to us is given by e-mail to legal@attestkeep.com, or by post to the registered address on the company page. Notice to you is given to the e-mail address on the account; keeping that address current is your responsibility, because it is also where the licence key and renewal notices go.

11. Acceptance and record

You accept this agreement, the terms of service and the privacy notice by ticking the box when you create an account and by confirming the order at checkout. Acceptance is recorded with the date and the version of the documents in force at that moment, and a copy of the order confirmation is sent to you by e-mail.

We may change these documents for future orders. A change never applies retroactively to a term you have already paid for: the version you accepted governs that term, and a material change is notified by e-mail before the next renewal so that cancelling remains a real option.
